Booking Conditions
VILLA ACCOMMODATION RESERVATION SERVICE AGREEMENT
PARTIES AND PURPOSE
This agreement is made between the person making a reservation for the villa/holiday home (hereinafter referred to as the “Client”) and Villaciniz Seyahat Turizm Ltd. Şti., acting as intermediary for the accommodation (hereinafter referred to as “VILLACINIZ”), for the rental of the villa/holiday home for accommodation purposes for a fixed period whose start and end dates are agreed in advance by the parties. Any renter — together with the persons accompanying them — who makes a reservation for any of the villas/holiday homes listed on the website www.villaciniz.co.uk, whether through the website, by telephone or by e-mail, is deemed to have accepted the terms and conditions set out below. In the event of conduct contrary to any of the terms below, VILLACINIZ shall be entitled to cancel the rental unilaterally, to require the renter to vacate the villa/holiday home, to retain the deposit and rental payments received, and to demand payment in full of all outstanding rental amounts.
RESERVATION AND PAYMENT
Pre-reservations for the villas/holiday homes marketed by us may be made through the reservation form on our website, by telephone or by e-mail. VILLACINIZ completes your rental by confirming the dates you wish to book and taking the necessary contact and invoicing details from you. Once the rental has been arranged, VILLACINIZ collects 35% of the total amount payable for the villa/holiday home as a deposit (advance payment). Provided the deposit is paid within one (1) business day of the booking, the villa/holiday home is reserved and held in your name. The deposit amount payable and our bank account details will additionally be communicated to you by e-mail, SMS or telephone. After receipt of payment, VILLACINIZ reserves the right to terminate the agreement unilaterally within one (1) business day. The deposit may be paid within one (1) business day by bank transfer, EFT, or by credit card through the website. Written confirmation of the rental of the villa/holiday home will be sent to you no later than one (1) business day after receipt of the deposit. The confirmation states the total price, the deposit received, the dates for which the villa is rented in your name, and the date and time on which your deposit was received. If the deposit is not paid within one (1) business day, VILLACINIZ may cancel the pre-reservation without notice to the renter and accept other reservations for the villa/holiday home. The remaining balance of the rental price is collected in cash, in advance, upon hand-over of the villa/holiday home after the agreement has been made and the property has been checked. In addition, as the property is handed over furnished, VILLACINIZ collects a damage deposit of TRY 500 / TRY 2,000 in cash upon hand-over, as security against breakage, damage, loss and similar matters affecting the furnishings. The damage deposit is refunded to the renter at check-out, after the inventory has been counted, provided nothing is missing. To prevent any inconvenience arising in this respect, we kindly remind you to have these amounts available in cash on the day of arrival.
CHECK-IN AND CHECK-OUT TIMES
On the reservation start date, check-in at the villa/holiday home is from 16:00 at the earliest and until 21:00 at the latest. The renter may not check in outside the stated hours; a renter arriving after the latest check-in time may check in the following morning at the start of VILLACINIZ working hours (09:00). VILLACINIZ can under no circumstances be held responsible for problems arising from the renter's inability to check in due to arriving earlier or later than the stated times — including overnight accommodation, inability to find accommodation and similar problems. In such cases the renter must find their own overnight accommodation and pay the cost of it themselves; VILLACINIZ cannot be held responsible for such situations. At the end of the reservation, check-out from the villa/holiday home is by 10:00 at the latest for all our regions. The Client is directly responsible for any problems, damages, losses and other adverse consequences arising from failure to vacate the villa/holiday home by 10:00 or from vacating it late, and is obliged to compensate VILLACINIZ for all financial losses that may arise from them. We strongly recommend that travel plans be made according to these times so that neither party is inconvenienced. If you wish to check out early, VILLACINIZ must be notified 24 hours in advance. If, due to a busy schedule, the renter checks out before the villa/holiday home can be inspected, the damage deposit will be transferred to a bank account to be notified by the renter. If the renter vacates the villa/holiday home early of their own accord, no refund of the accommodation price will be made to the renter.
VILLA / HOLIDAY HOME CAPACITY
Under no circumstances are guests admitted to our villas/holiday homes in excess of the capacity stated on our website or of the number of persons declared when the reservation was made (children and infants included). If, after the rental has been confirmed, the renter wishes to make a change to the number of persons, a written application must be made to VILLACINIZ, and the change may be approved at VILLACINIZ's discretion, depending on the capacity of the villa/holiday home. VILLACINIZ may request an additional fee from the renter. After check-in, no guests other than those named on the reservation list are admitted to the villa/holiday home under any circumstances. Where a breach is identified, VILLACINIZ is entitled to require the guests to leave the villa/holiday home, to cancel the reservation entirely or to require the property to be vacated completely without waiting for the end of the rental period, and to demand the full price together with an additional fee. Rentals are processed on the basis of the renter's declaration; the renter accepts that the information they have provided is accurate and complete and accepts all liability arising in this respect.
CLEANING / MAINTENANCE AND EXTRA CHARGES
Check-in cleaning is included in the daily, weekly and monthly rental prices. For stays of two (2) weeks or longer, weekly cleaning and a change of towels, bed linen and similar items are included in the price. Any cleaning or towel/linen change requested beyond this is subject to a charge. For stays shorter than the minimum stay at our villas, an extra short-stay fee may be added to the total amount; this fee may vary from villa to villa and is published in the prices section of our website. Pool and garden maintenance is carried out early each morning, and any technical problem at the villa during the rental period will be remedied by the property owner. The property owner is responsible for all issues that may arise in connection with pool and garden maintenance. VILLACINIZ is solely an intermediary in the rental transaction and is in no way responsible for problems that may arise; it only assists in resolving them. For the periodic maintenance of the pools, gardens and other fixtures of all villas/holiday homes, authorised staff need to enter the garden or the interior of the property. So that these services can be carried out without interruption, the renter must allow authorised staff to enter the villa/holiday home where necessary. Unless otherwise stated on the villa/holiday home detail page of our website, electricity, water, bottled gas, pool lighting, internet connection and air-conditioning use are included in the prices. Pool lighting, air conditioning and internet may not be standard in every villa/holiday home; you are therefore advised to read the features of the villa/holiday home you are renting carefully on our property features page.
PETS / SMOKING
Unless otherwise stated, pets are strictly not admitted to our villas/holiday homes. Smoking is not permitted in the indoor areas of any of our villas/holiday homes.
PRICES
The villa/holiday home rental prices stated on our website are daily, weekly and monthly rates. The deposit may be paid into our bank accounts by bank transfer, by EFT, or through the credit card payment system.
RESERVATION / PAYMENT / CANCELLATION TERMS AND REFUND CONDITIONS
The advance payment portion of the villa/holiday home reservation price paid into our account (by EFT, bank transfer, single-payment credit card, cash, or mail order) is non-refundable from the moment you make the payment, even for cancellations made at any time up to 30 days before your check-in date, because the whole of this payment has been made to the property owner as an advance. The remaining balance must be paid to us on arrival at the villa/holiday home. The Client may cancel their trip before it begins. Cancellation notices must be given to VILLACINIZ in writing; notices not given in writing cannot be accepted. In the event of cancellation, VILLACINIZ will charge the Client specified percentages of the total price of the services stated in the travel agreement, to cover the measures it has taken and the costs it has incurred in connection with the trip. These amounts are determined as follows.
Cancellation terms:
a- The 35% (or, where applicable, 20%) deposit collected by us for the villa reservation is strictly non-refundable.
b- If the villa reservation is cancelled at any time up to 30 days before the check-in date, 35% of the villa rental price must be paid.
c- If the villa reservation is cancelled 29 days or fewer before the check-in date, 100% of the villa rental price will be charged.
d- If the reservation is cancelled by VILLACINIZ for any reason, we will notify you as soon as possible. At the same time, if another villa with the same features is available in our portfolio for the same period, it will be offered to our guest. In cases of force majeure (earthquake, flood, disaster, etc.), the full amount paid will be refunded to the guest.
e- If, after completing a reservation through VILLACINIZ, you fail to arrive at the specified villa or check out early, no refund whatsoever will be made.
f- Where a separate special cancellation policy applies to certain villas/holiday homes in our portfolio, this is expressly stated in the information section for the property concerned.
g- Refund requests must be notified in writing by e-mail or by registered post with return receipt; such notices take effect from the moment they reach us.
h- If, after paying the deposit, the Client fails to make the remaining payment on time, VILLACINIZ reserves the right to accept reservations for the specified villa from other persons.
k- After receipt of payment, VILLACINIZ reserves the right to terminate the agreement unilaterally within one (1) business day. In such cases the refund will be made to the Client's bank account or credit card within one (1) day. If, for any reason, a villa/apartment reservation is cancelled unilaterally by VILLACINIZ, the Client will be notified as soon as possible. If an equivalent villa/apartment is available in our portfolio for the same dates, it will be offered to the Client. If the Client does not accept it, and in cases not falling under the “force majeure” clause, the amount received will be refunded to the Client. VILLACINIZ is in no way responsible, and cannot be held responsible, for losses arising from reservations cancelled by VILLACINIZ — including flight tickets or bus tickets purchased in advance by the Client, cars, boats or transfer services hired, hotel and guesthouse accommodation costs, any other expenses paid, or the forfeiture of permits obtained from private companies or public authorities. The Client making the villa/apartment reservation accepts that they have taken this into account.
EXCEPTIONAL CIRCUMSTANCES
In circumstances entirely beyond our control — war, threat of war, civil unrest, terrorist acts, natural disasters, health risks, epidemics (Covid-19 and the like), or the death of a first-degree relative of the reservation holder — and provided the necessary documents are submitted to our company, the advance payment made for the reservation will be held as a credit for use against a different reservation and will be deducted from the total price of the new reservation. The total price of the new reservation may vary depending on the property selected or the dates of the stay.
DAMAGE DEPOSIT
A damage deposit in an amount that varies according to the characteristics of each villa/holiday home will be collected from the renter. The deposit amount is stated in writing in the confirmation document sent to the renter during the reservation process. The damage deposit is collected from the renter in cash on the day of arrival and, following the inspection carried out before the renter leaves the property, is refunded in cash provided that the villa/holiday home — handed over in sound condition — and its inventory show no damage, loss or missing items. If the renter wishes to leave the property earlier than the time stated in the agreement, or if the check-out inspection cannot be carried out due to a busy schedule, the deposit will be transferred to a bank account to be obtained from the renter. If the damage caused at the villa/holiday home exceeds the amount of the deposit collected, the renter will be required to pay for the damage; otherwise legal proceedings will be initiated.
SWIMMING POOLS
The water temperature of the swimming pools at our villas/holiday homes varies according to the weather and seasonal temperatures. VILLACINIZ can under no circumstances be held responsible if the Client who booked the villa/holiday home is unable to use the pool because the water is cold. Clients booking a villa/holiday home may check the weather for the dates of their stay on the website of the Turkish State Meteorological Service or by telephoning the Turkish State Meteorological Service. VILLACINIZ can under no circumstances be held responsible for adverse weather conditions.
OUR RESPONSIBILITIES AND GUARANTEE
VILLACINIZ is responsible for handing the villa/holiday home over to the renter clean and ready for use on the agreed date and time. If, at check-in, any item is found to be broken or not working, or any other defect is found, the renter must notify VILLACINIZ immediately and request that the defect be remedied. VILLACINIZ will pass this request on to the property owner or the relevant company and will ensure that the defect is remedied within 48 hours at the latest. VILLACINIZ is not itself responsible for remedying the defect; it assists in having it remedied. VILLACINIZ cannot be held responsible for defects that are not reported in good time. VILLACINIZ acts as an intermediary between the property owner and the renter, and responsibility for remedying defects that may arise at the villa/holiday home therefore lies with the property owner. Beyond this, VILLACINIZ cannot be held responsible for any accident, illness, injury, drowning in the pool, death or similar events falling within the renters' own responsibility, nor for fire, theft or similar incidents or accidents that may occur at the villa/holiday home. Furthermore, VILLACINIZ shall in no way be responsible for problems arising from any services obtained by renters from third parties/companies — excursions, shopping, food, drink, entertainment, transport, travel, guiding services and the like — whether while travelling to the villa/holiday home, returning from it, or during the holiday. After leaving the villa/holiday home, the Client (reservation holder) may not claim any right or refund in respect of a service they did not receive due to a defect, problem or fault that they did not report to VILLACINIZ during their stay.
INVOICING – TAX
None of the villas or holiday homes published on the VILLACINIZ website belongs to VILLACINIZ. Each villa/holiday home has different owners — private individuals or companies. VILLACINIZ acts as an intermediary marketing the villas/holiday homes of these individuals and companies to the Client. For this reason, VILLACINIZ issues an invoice for its service fee only. That is, out of the amount paid by the Client, VILLACINIZ earns a certain service fee margin and issues an invoice for that earning; this margin may differ for each villa. As the remaining amount is the property owner's earning, VILLACINIZ does not issue an invoice for it. VILLACINIZ does not issue invoices for earnings of third parties, institutions, individuals or companies, and is in no way responsible for them, nor can it be held responsible.
RIGHT OF WITHDRAWAL
Pursuant to subparagraph (g) of Article 15 of the Regulation on Distance Contracts, prepared on the basis of Articles 48 and 84 of the Consumer Protection Law No. 6502, the consumer may not exercise a right of withdrawal in contracts relating to accommodation, transport of goods, car rental, supply of food and drink, and the use of leisure time for entertainment or recreation purposes, which must be performed on a specific date or within a specific period.
CLIENT'S RESPONSIBILITIES
The Client is obliged to use the villa/holiday home, the pool, the garden furniture, all electrical and electronic equipment handed over to them at the property in working and sound condition, and all other furniture, with care and cleanliness. The Client must leave all kitchenware, which was handed over clean, in the same clean condition. If the villa is left dirty beyond reasonable limits, VILLACINIZ will deduct a cleaning fee from the damage deposit. In the event of any damage occurring at the villa/holiday home, renters are obliged to inform VILLACINIZ. The cost of any damage caused to the villa/holiday home and of any items lost by renters during their stay will be deducted from the damage deposit where one has been collected; where the damage exceeds the damage deposit, the renter will be required to pay the difference in cash. In addition, the renter and those accompanying them must take care to comply with social and moral rules, not to make noise that disturbs the neighbourhood, not to play loud music, and not to engage in conduct that is prohibited and constitutes an offence under the laws of Türkiye. If a complaint about the renter and those accompanying them reaches VILLACINIZ on such grounds, VILLACINIZ is entitled to require the renter to vacate the villa/holiday home before the end of the reservation period. For villas described on the website as conservative (villas whose pool is not visible from outside), VILLACINIZ does not give a guarantee of seclusion for properties that do not carry the description “one hundred percent secluded”. Renters staying in such villas must provide for their own privacy and take their own security precautions against intrusion, theft and other criminal acts. VILLACINIZ accepts no responsibility for such problems and can under no circumstances be held responsible for them. The Client undertakes to vacate the villa unconditionally on the end date and at the end time of the rental period.
FORCE MAJEURE
In situations falling within the scope of force majeure, VILLACINIZ may terminate this agreement unilaterally without incurring any legal liability. War or the threat of war in the region or the country, uprisings, strikes, natural disasters, fires, terrorist activities, epidemics, technical problems that may arise in transport, superstructure and infrastructure works carried out by municipalities or public institutions that VILLACINIZ cannot prevent, bans imposed by state authorities in the region, and all unforeseeable events beyond our control shall be regarded as force majeure.
COMPLAINTS
Renters shall notify VILLACINIZ of any complaints during their stay at the villa/holiday home. The matter complained of will be investigated by VILLACINIZ staff and the necessary measures will be taken immediately. VILLACINIZ can under no circumstances be held responsible for complaints that were not raised during the stay and are made only after the stay has ended and the renter has left the villa/holiday home.
SECURITY AND PRIVACY POLICY
VILLACINIZ will not disclose personal information to any company or to third parties, except in the cases defined in this Privacy Policy and Terms of Use. VILLACINIZ never sells the personal information of visitors, registered users or partners to third parties. Personal information means any information that serves to identify the user, such as name and surname, address, telephone number and e-mail address. VILLACINIZ may use personal information within its own organisation to build user profiles and to carry out statistical studies, and may share it with third parties solely for the purpose of carrying out such studies. VILLACINIZ undertakes to keep personal information strictly private and confidential, to treat this as a duty of confidentiality, to ensure and maintain confidentiality, and to take the necessary measures and exercise due care to prevent all or any part of the confidential information from entering the public domain or being used without authorisation or disclosed to a third party. Notwithstanding the information security measures taken by VILLACINIZ, VILLACINIZ shall bear no responsibility if confidential information is damaged or obtained by third parties as a result of attacks on the www.villaciniz.co.uk website and its systems. The www.villaciniz.co.uk website may contain links to other sites. www.villaciniz.co.uk bears no responsibility for the privacy practices or the content of sites accessed via such links. www.villaciniz.co.uk identifies and uses users' IP addresses where necessary. IP addresses may also be used to identify users in a general manner and to gather comprehensive demographic information.
OTHER IMPORTANT INFORMATION
1) VILLACINIZ can under no circumstances be held responsible for conditions beyond its control, such as the roads leading to the villa/holiday home being in poor condition, uphill, unpaved (stabilised), wet and the like.
2) VILLACINIZ can under no circumstances be held responsible for accidents or any other adverse events that may occur while travelling to the villa/holiday home.
3) VILLACINIZ can under no circumstances be held responsible if the various materials used in the construction of some villas (cedar wood, pine wood, certain plastic products, any plants in the garden or inside the villa, etc.) cause the renter discomfort on health grounds.
4) Renters staying at all of our villas/holiday homes will need a private vehicle. Transport to the villa/holiday home is the renter's own responsibility.
5) The renter may obtain a taxi, transfer vehicle or hire car from third parties. VILLACINIZ does not intervene in transfer or taxi services, or in vehicles hired or to be hired from third parties. These arrangements are the renter's own responsibility.
6) VILLACINIZ cannot be held responsible if the renter is dissatisfied with the geographical location of the villa or holiday home they have rented. VILLACINIZ has marked the location of the villa/holiday home approximately on Google Maps.
7) VILLACINIZ cannot be held responsible for damage to the renter's own or hired vehicle while travelling to the villa/holiday home.
8) Any adverse consequences arising from the renter's vehicle (motorcycle, car, etc.) having low ground clearance or insufficient engine power, from the renter's shortcomings in driving a car, motorcycle or other vehicle, or from a consequent inability to reach the villa/holiday home, are the renter's own responsibility. VILLACINIZ can under no circumstances be held responsible for these or similar problems.
9) The “distances table” shown on the property detail page at www.villaciniz.co.uk is approximate. Distances are not stated with complete precision and some discrepancies may occur. The renter accepts to take this into account.
10) The “airport” stated in the distances table on the property detail page at www.villaciniz.co.uk is the airport nearest to the villa/holiday home. This may be Dalaman, Bodrum, Antalya or another airport. You should ask a VILLACINIZ representative which airport is nearest. Otherwise, VILLACINIZ cannot be held responsible for problems arising from purchasing a flight ticket to the wrong or a more distant airport.
11) The distances stated in the distances table on the property detail page at www.villaciniz.co.uk are based on the nearest restaurant, the nearest beach, the nearest settlement, the nearest road served by public transport and the nearest airport. VILLACINIZ accepts no responsibility if a stated restaurant or market has closed down.
12) VILLACINIZ cannot be held responsible for accidents such as drowning or falls in the pool at the villa/holiday home.
13) No food, drink or other provisions are supplied at our villas/holiday homes. Obtaining these items is the Client's own responsibility. VILLACINIZ cannot be held responsible for such matters.
14) Most of the villas have a solar-heated hot water tank of approximately 160 litres. The Client is directly responsible for problems caused by hot water running out due to excessive consumption beyond fair use. VILLACINIZ cannot be held responsible for problems arising from this situation.
15) VILLACINIZ can under no circumstances be held responsible for situations such as there being no mobile phone signal, a weak signal, or no mobile internet reception at the villas/holiday homes or on the road. You may call your mobile network operator for detailed information about signal coverage in the area you are travelling to.
16) VILLACINIZ cannot be held responsible for any accidents or incidents at the villa/holiday home caused by the renter — fire, electrical leakage, gas leakage and any resulting death or injury — nor for telephone and internet outages caused by the internet provider (Türk Telekom, etc.), power cuts caused by the electricity company, or water cuts caused by the water company.
17) Even if you have paid by credit card, mail order, EFT, bank transfer or similar means, do not under any circumstances purchase flight tickets, bus tickets or the like before you have received your confirmation e-mail and confirmation document. Even if you have made payment to VILLACINIZ, you are not deemed to have rented the villa/holiday home unless the confirmation e-mail and confirmation document have been sent to you. VILLACINIZ can under no circumstances be held responsible for material or moral losses that may arise from the Client acting hastily in such situations.
18) The villas/holiday homes presented on our website are exactly as shown. Claims that a property is not as it appears on the website, that it looks better on the website, or that it is larger or smaller than on the website, and similar claims, can never be accepted, and VILLACINIZ cannot be held responsible for them.
19) VILLACINIZ cannot be held responsible for any adverse consequences of natural events or conditions, favourable or unfavourable, or of weather conditions, favourable or unfavourable.
20) VILLACINIZ cannot be held responsible for events such as bee, scorpion or insect stings, snake bites, cat or dog bites and the like suffered by the renter.
21) Clients wishing to choose a conservative villa — described as a villa whose pool is not visible from outside — should note that if the property detail page does not contain statements such as “this villa is suitable for conservative families”, “the pool is not visible from outside”, or “suitable for guests observing Islamic dress”, then that villa is not a conservative villa. VILLACINIZ is in no way responsible where a client rents a villa without such statements and then holds VILLACINIZ at fault. We recommend that clients read all details carefully before renting a villa.
22) This agreement is governed by Turkish law. The Courts and Enforcement Offices of Kaş (Antalya) shall have jurisdiction over disputes arising from this agreement.
23) Neither party shall assign or transfer any benefit arising from this agreement, any part of this agreement, or any interest in this agreement — whether subject to a pre-existing condition or otherwise — without the prior written consent of the other party, nor make any attempt to do so.
24) The invalidity of any provision of this agreement shall not affect the validity of the remaining provisions. Invalid provisions shall be amended or replaced in order to preserve the purpose and the continuity of the agreement.
25) Stamp duty arising from this agreement shall be borne by the Client.
26) The CLIENT accepts, declares and undertakes in advance that the information and documents they have provided under this agreement are complete and accurate, that the IP address used belongs to them, and that they accept in advance all liability arising or that may arise therefrom; that if they provide false or inaccurate information the agreement may be terminated by VILLACINIZ with immediate effect; and that in the event of such termination they may not demand the restitution, cancellation or amendment of the obligations under the agreement.
27) When accessing the website, the CLIENT may not use another person's IP address, e-mail address, username or other details, nor may they access or use other users' confidential information without permission. Otherwise, all legal and criminal liability lies with the Client
